Terms of Sale, Use & Licence
Read this before you buy
Disciplinary Guide is not a firm of attorneys and these templates are not legal advice. Disciplinary Guide is a product of Focus Legal (Pty) Ltd, an industrial relations and human resources consultancy. It does not practise law and is not registered with the Legal Practice Council. Buying a template does not create an attorney–client relationship and does not attract legal professional privilege. You are responsible for the content you insert into a template and for the fairness of the process you follow.

2. What you are buying
You are buying a single, non-exclusive licence to use a document template, generated as a PDF with the details you entered merged into it. You are not buying legal services, representation, or an opinion on your matter.
Each product page states the number of pages and what the document contains. You can preview the complete document, watermarked, before you pay. Preview it before you buy — that is what the preview is for.
3. Price and payment
- Prices are shown in South African Rand on the product and build pages. No VAT is charged. Focus Legal (Pty) Ltd is not a registered VAT vendor, so a purchase does not entitle you to an input tax deduction and no tax invoice for VAT purposes is issued.
- Payment is by card through Yoco. The transaction is concluded when Yoco confirms the payment.
- Your card receipt is issued by Yoco to the e-mail address you provide at checkout.
- We do not store card details. We never see them.
- If a price is displayed in error, we may decline the order and refund you in full. We will not hold you to an obvious mistake, and you may not hold us to one.
4. Delivery
The document is generated in your browser and downloads to your device immediately after payment. There is no shipping and nothing is posted.
Delivery depends on your browser
Because the document is built on your device and never uploaded to us, the download page only works in the same browser, on the same device, that you built the document in. If you build on a laptop and pay on a phone, return to the laptop to download. If you cannot retrieve your document, e-mail legal@focuslegal.co.za with your order code and your Yoco receipt and we will send it to you.
5. Licence — what you may and may not do
You may
- Use the template as often as you need within your own business, including for more than one employee and more than one matter.
- Edit, adapt and rebrand the document for your own internal use.
- Print it, circulate it internally, and hand it to an employee, a chairperson or a representative in the ordinary course of a matter.
- Produce it to the CCMA, a bargaining council, a court, or an opposing party as part of a matter.
You may not
- Resell, sublicense, rent or otherwise commercially distribute the template or any document derived from it.
- Supply it to third parties as part of your own consulting, HR or legal service offering, or hold it out as your own product.
- Publish it, upload it to a template library, or make it publicly available.
- Remove or obscure the attribution in the document footer, except in a document actually issued to an employee in a live matter.
Copyright in the templates remains with Focus Legal (Pty) Ltd. The licence is granted to the purchasing business, not to an individual, and is not transferable on sale of the business without our written consent.
6. Cooling off and refunds
See the Refund Policy, which forms part of these terms and sets out the position under sections 42 to 44 of ECTA and the Consumer Protection Act 68 of 2008 for a digital product that is downloaded immediately.
7. No advice, no warranty of outcome
- The templates are general documents. They are not drafted for your facts, your industry, your bargaining council or your disciplinary code.
- We do not warrant that using a template will produce a fair dismissal, survive arbitration, or achieve any outcome.
- Labour legislation, codes and case law change. We update the templates from time to time but do not warrant that any template reflects the law as at the date you use it.
- You must satisfy yourself that the document is appropriate before you issue it. Where the matter is serious, contested, or the employee is represented, take advice.
8. Limitation of liability
To the fullest extent permitted by law, and subject to the Consumer Protection Act where it applies, Focus Legal (Pty) Ltd, its directors, employees and contractors will not be liable for any indirect, incidental, special or consequential loss, loss of profit, loss of business, reputational harm, or any award, order or costs made against you in any forum, arising out of the use of a template. Our total liability arising from any template is limited to the amount you paid for that template.
Nothing in these terms excludes liability for fraud, wilful misconduct, or any liability that cannot lawfully be excluded.
9. Your information
How we handle personal information is set out in the Privacy Notice. In short: the content you type into the builder stays in your browser and is never transmitted to us. We receive only the payment information Yoco passes to us — your name, e-mail address, amount and order reference.
10. Availability
We do not warrant that this website will be available uninterrupted or error free. We may add, change, withdraw or reprice templates at any time. A change in price does not affect an order already paid for.
11. Governing law and disputes
These terms are governed by the law of the Republic of South Africa. Raise any complaint with us first, in writing, at legal@focuslegal.co.za. You consent to the jurisdiction of the Magistrate’s Court having jurisdiction over you in terms of section 45 of the Magistrates’ Courts Act 32 of 1944, without prejudice to our right to proceed in any other court with jurisdiction.
12. Changes to these terms
The version published on this page at the time of your purchase governs that purchase. We may amend these terms for future purchases at any time.
